ACCEPTABLE USE POLICY

This Acceptable Use Policy (“AUP“) describes prohibited uses of JavisTab Services.

This AUP forms part of the JavisTab Terms and Conditions.

By using JavisTab, you agree not to use the Services for activities prohibited by this AUP or applicable law.


1. GENERAL REQUIREMENT

Customer must use JavisTab:

  • lawfully;
  • responsibly;
  • securely;
  • in accordance with the Terms;
  • in accordance with applicable Third-Party Service terms; and
  • without interfering with other customers or the Services.

2. PROHIBITED ACTIVITIES

Customer must not use JavisTab to:

2.1 Illegal Activities

  • violate applicable law;
  • facilitate criminal activity;
  • facilitate fraud;
  • facilitate money laundering;
  • evade sanctions;
  • facilitate terrorism;
  • facilitate trafficking;
  • distribute unlawful content; or
  • assist another person in committing an unlawful act.

3. FRAUD AND DECEPTION

Customer must not use JavisTab to:

  • impersonate another person or business;
  • create fraudulent restaurant websites;
  • conduct phishing;
  • misrepresent reservation availability;
  • manipulate booking information for fraud;
  • deceive customers;
  • create fake booking confirmations;
  • conduct payment fraud; or
  • facilitate identity theft.

4. MALWARE AND SECURITY ABUSE

Customer must not use the Services to distribute or facilitate:

  • malware;
  • ransomware;
  • spyware;
  • viruses;
  • worms;
  • trojans;
  • malicious scripts;
  • credential stealers;
  • keyloggers; or
  • other malicious software.

Customer must not attempt to:

  • gain unauthorized access;
  • bypass authentication;
  • exploit vulnerabilities;
  • attack JavisTab infrastructure;
  • attack another customer’s website;
  • perform denial-of-service attacks;
  • conduct port scanning without authorization;
  • interfere with servers;
  • circumvent security controls; or
  • obtain unauthorized credentials.

5. SPAM AND ABUSIVE COMMUNICATIONS

Customer must not use JavisTab or its integrations to send unlawful or abusive:

  • email;
  • SMS;
  • notifications;
  • marketing communications;
  • automated messages; or
  • other communications.

Customer must comply with applicable anti-spam and electronic communications laws.

Customer is responsible for ensuring that recipients have the appropriate legal basis or consent where required.


6. PERSONAL DATA MISUSE

Customer must not use JavisTab to unlawfully:

  • collect personal information;
  • sell personal information;
  • expose personal information;
  • publish private information;
  • collect sensitive information without lawful basis;
  • monitor individuals unlawfully;
  • create unauthorized profiles;
  • scrape personal information; or
  • disclose personal information without authorization.

Customer remains responsible for complying with applicable privacy laws.


7. PROHIBITED CONTENT

Customer must not intentionally use JavisTab to host, distribute, or facilitate content that is unlawful, including:

  • child sexual abuse material;
  • terrorist content where prohibited by law;
  • content promoting violent criminal activity;
  • fraudulent schemes;
  • stolen credentials;
  • malware;
  • illegal goods or services; or
  • content that violates applicable law.

JavisTab does not assume responsibility for user-generated content hosted on Customer-controlled websites, except where required by law or where JavisTab itself controls the relevant content or service.


8. INTELLECTUAL PROPERTY ABUSE

Customer must not use JavisTab to:

  • infringe copyrights;
  • infringe trademarks;
  • distribute pirated software;
  • distribute stolen source code;
  • distribute unauthorized copies of plugins;
  • circumvent software licenses; or
  • facilitate intellectual-property infringement.

9. LICENSE ABUSE

Customer must not:

  • share License Keys with unauthorized users;
  • bypass domain restrictions;
  • clone or redistribute JavisTab;
  • sell unauthorized copies;
  • remove license controls;
  • circumvent activation systems;
  • reverse engineer proprietary license mechanisms; or
  • provide unauthorized access to paid features.

10. API ABUSE

Where JavisTab provides APIs, Customer must not:

  • exceed documented rate limits;
  • send malicious requests;
  • scrape API endpoints;
  • attempt credential attacks;
  • overload infrastructure;
  • reverse engineer undocumented APIs;
  • circumvent authentication;
  • use APIs to build unauthorized competing services; or
  • interfere with service availability.

JavisTab may impose reasonable rate limits to maintain system reliability.


11. AUTOMATION AND BOTS

Automated access is permitted only where expressly supported.

Customer must not use bots, scripts, crawlers, or automation to:

  • overload systems;
  • scrape data;
  • circumvent access restrictions;
  • create fraudulent accounts;
  • generate fake bookings;
  • generate artificial traffic;
  • manipulate analytics;
  • abuse trials; or
  • interfere with normal operation.

12. BOOKING ABUSE

Customer must not intentionally use JavisTab to:

  • create fraudulent reservations;
  • generate fake bookings;
  • manipulate availability;
  • intentionally create double bookings;
  • disrupt another restaurant’s operations;
  • conduct reservation attacks;
  • use bots to consume booking capacity; or
  • interfere with legitimate customer reservations.

13. PAYMENT ABUSE

Customer must not use JavisTab to:

  • process fraudulent transactions;
  • test stolen payment credentials;
  • facilitate chargeback fraud;
  • manipulate payment records;
  • evade payment processor restrictions; or
  • violate payment processor terms.

14. THIRD-PARTY SERVICES

Customer must comply with the applicable terms of:

  • WordPress;
  • payment processors;
  • POS providers;
  • email providers;
  • SMS providers;
  • hosting providers;
  • analytics services; and
  • other Third-Party Services.

JavisTab may suspend an integration where continued operation creates legal, security, or operational risk.


15. SECURITY RESEARCH

Security research involving JavisTab must be conducted responsibly.

Customers should report suspected vulnerabilities to:

service@javistab.com

Customers must not:

  • exploit vulnerabilities against production systems;
  • access another customer’s data;
  • destroy data;
  • disrupt services;
  • publicly disclose sensitive vulnerability details before reasonable remediation opportunity; or
  • use vulnerability research to obtain unauthorized benefits.

16. ENFORCEMENT

If JavisTab reasonably believes that Customer has violated this AUP, JavisTab may:

  • investigate;
  • request information;
  • issue warnings;
  • remove or restrict access;
  • suspend an Account;
  • suspend a License;
  • disable integrations;
  • limit API access;
  • terminate the Services; or
  • take other reasonable protective measures.

Where reasonably practicable, JavisTab will consider the severity, frequency, intent, potential harm, and applicable legal requirements.


17. IMMEDIATE SUSPENSION

JavisTab may immediately suspend Services where reasonably necessary to address:

  • security threats;
  • malware;
  • fraud;
  • credential compromise;
  • illegal activity;
  • significant service abuse;
  • attacks against infrastructure;
  • serious privacy violations; or
  • urgent legal requirements.

18. REPORTING ABUSE

To report suspected abuse:

Reports should include sufficient information for JavisTab to investigate the issue.


19. CHANGES TO THIS AUP

JavisTab may update this AUP from time to time.

Material changes may be communicated through the website, Account, email, or other reasonable means.
